Offers and entering into a contract
Based on your enquiry we prepare a written offer setting out the scope, price, timeline, payment terms and how long the offer is valid.
The contract is made when you accept the offer in writing, including by email, or when you pay an advance if the offer provides for one.
Prices and payment
Prices are in euros. Not registered for VAT (Croatian VAT Act, Art. 90(1)). No VAT is therefore charged.
Payment follows the schedule in the offer, against an invoice, to the account stated on the invoice. Late payments bear statutory default interest.
Timelines and your input
Timelines are set out in the offer. Meeting them depends on you providing content, materials, access and feedback on time; any delay on your side extends our timelines by the same amount.
Changes and additions beyond the agreed scope are not included in the price. We agree them separately before starting work on them.
Handover and complaints
When the work is finished we let you know it is ready for review. Report any defects that depart from what was agreed within the period stated in the offer; we fix such defects at no extra charge.
You can send a complaint in writing to [email protected] or by post to our registered seat. We confirm receipt without delay and send a written reply within 15 days of receiving it.
Copyright
Until the agreed price is paid in full, all rights in the work remain with ANIM. Once it is paid in full, you may use the work to the extent set out in the offer.
Third-party parts — fonts, open-source libraries, photos and the like — are used under their rights holders' licences. ANIM keeps the rights to general tools and its own code not made specifically for you.
We may show the finished project in our portfolio unless you refuse in writing.
Your content
You warrant that you hold the rights to the content and materials you give us and that publishing them does not infringe anyone else's rights. You are responsible for the content you publish on your site.
Hosting, maintenance and third-party services
Hosting, domains, licences and third-party services (such as AI services) are included only if the offer lists them. Their providers are responsible for their availability and outages.
Maintenance and support after handover are provided only if agreed.
Liability
Towards business clients we are liable for damage caused intentionally or through gross negligence. Liability for lost profit and indirect damage is excluded, and total liability is limited to the amount paid for the service that gave rise to the damage.
Towards consumers we are liable as the law provides; these limits do not apply to them.
Consumers' right of withdrawal
If you are a consumer and we made the contract at a distance (for example by email), you may withdraw from it within 14 days of making it, without giving a reason.
Send your withdrawal to [email protected] or by post to our registered seat; we include a model withdrawal form with the offer, but you do not have to use it.
If, at your express request, we start work before that period ends and you then withdraw, you pay a proportionate amount for the work done up to the withdrawal. If the service is fully performed within that period with your express consent and your acknowledgement that you lose the right of withdrawal, the right ends.
Governing law and disputes
Croatian law applies. We try to settle any dispute amicably.
Disputes with business clients go to the competent court for the craft's registered seat. Consumers may also turn to an alternative consumer dispute resolution body, and their statutory right to go to court is not limited.
Changes to these terms
We may change these terms and publish the changes on this page with a date. Each project is governed by the terms in force when you accepted its offer.
